Comments:
Giving the Secretary of Defense "sole, exclusive, and un-reviewable" authority clearly exceeds the intent of Section XI of the 2004 NDAA. Further, it goes against one of the founding principles of a free democracy, the esablishment of a system of checks and balances. Congress intended to give the Secretary more "flexibilites", but not to establish a dictatorship within the U.S. Government. DoD would be well advised to consider that keeping third parties out of the system will only add cause for suspicion. Eliminate or reduce the role of the proposed National Security Labor Relations Board and keep the MSPB and FLRA to maintain public accountability. The DoD cannot hide its activities behind the shroud of national security forever!
