If a person is on an appointment with a not to exceed date and the person expects to be employed for that period but DoD lets the person go early, is that an adverse action? I cannot tell from the way 9901.704(d)(4) is written. Please make it easy to understand whether that is an adverse action or not. If it is not an adverse action, can it be appealed under subpart H? 9901.805 (a) makes it seem like it can be appealed.
