Department of Defense Docket Number NSPS-2005-001 Regulatory Information Number 3206-AK76 Subpart A - General Provisions, ? 9901.102 - Eligibility and Coverage, (b) in relevant part states, "At his or her sole and exclusive discretion, the Secretary may, subject to ? 9901.105 (b) - (1) Establish the effective date for applying Subpart I". The proposed NSPS Regulations should not go into effect until Subpart I is effective. The DoD and OPM must collaborate, collective bargain, with the Unions, negotiating as equals, Subpart I satisfying all three parties before the Regulations go into effect.
