March 10, 2005 DoD NSPS Comments , DoD NSPS Comments: I am retired military disabled combat veteran and employed as a civil service worker. I feel very strongly that the new NSPS system is detrimental to the civil service worker for the following reasons: Subpart A-Page 7557 Continuing Collaboration This would basically eliminate any case law for bargaining which could leave the worker unprotected on subjects like personal prejudices and arbitrary, capricious decisions. Subpart B-Conversion There is no provision to ensure that your pay will be made whole or there will be pro-rates amounts given towards their next step or career ladder promotion. Subpart B-Classification, Page 7578 & 7579 If you refer to subpart A at 9901.103 you will see that this allows the supervisor impose his or her personal prejudices or playing favorites. If the worker gives 100%, knows their job, does it outstanding, is professional in the workplace, the worker behavior, i.e. the way they dress, manner of performance, professional demeanor, etc. should not be able to be rated so subjectively by the supervisor. Then to make it worse, by NSPS regulation, this action is non-grievable. Subpart B-Performance Base Pay, Page 7860 With one giant pay pool and your performance pay coming out of this pool equal to the number of shares your supervisor rates you, this could allow two workers doing the same job equally or even one worker being better at the job, but because of the supervisor prejudices i.e. color, religion, sex? the lower producing worker could receive more shares which relates to more money. This is also non-grievable. Subpart C-Reduction in Band How could you allow your supervisor without any due process "reduce your pay" by as much as 10%? Workers could actually loose homes, go bankrupt, kids have to quit school. You take 10% from a worker with no due process and the worker not having an independent avenue to rebuttal that decision, could ruin a very valuable worker and family. Sincerely,
