Department of Defense Docket Number NSPS-2005-001 Regulatory Information Number 3206-AK76 Subpart H - Appeals, ?? 9901.801 - 9901.810: Congress needs to prohibit DoD and OPM from establishing a separate Judicial system outside our existing ones. The proposed Regulations allow DoD and OPM to have authority to reverse the initial MSPB decisions by claiming an impact on the Department's National Security Mission, erroneous interpretation of the law, government-wide rules and/or regulations. This proposed regulation would be placing the DOD and OPM at the same level of our Supreme Court system. Congress should strike out DoD's and OPM's proposal other than actually proving that the Department's National Security Mission would be impacted.
