Department of Defense Docket Number NSPS-2005-001 Regulatory Information Number 3206-AK76 Subpart H - Appeals, ?? 9901.801 - 9901.810: If a penalty is "wholly without Justification", why should the MSPB and arbitrators mitigate in the first place? Congress needs to get DoD and OPM to sit down with the Federal Employee's Representatives and work out a viable solution.
