Department of Defense Docket Number NSPS-2005-001 Regulatory Information Number 3206-AK76 Subpart H - Appeals, ?? 9901.801 - 9901.810: Congress needs to stop the DoD and OPM from destroying the Federal Employees ability to appeal. DoD and OPM propose to limit the MSPB appeal process in such a way that the Federal Employee cannot reasonably be able to defend themselves in adverse actions. The problem with the current appeal process is not associated with the changes proposed within the regulations. The problems the DoD and OPM are having with the MSPB Appeals is created from the Agency's representatives not following the rules. Therefore, if the Agency's Representatives cannot follow the rules now, what makes DoD and OPM think they will be able to follow the new rules. Congress needs to demand DoD and OPM rewrite the regulations to reflect the current regulations for MSPB Appeals.
