As stated on page 7560, under the heading titled “ Rating Methodology”, in the supplementary information of the proposed regulations, a pay pool manager and committee will determine pay increases. The results of the pay increase determinations should be transparent to ensure fair and accurate distribution. By allowing individual employees to view the distribution of pay within their assigned pay pool, any unfair apportionment will be highly improbable. Additionally, this will discourage raters from showing favoritism towards any specific employee or group of employees. Employees should have the right to challenge pay increases of other employees if proof of cause warrants a challenge. Prejudice and preferential treatment remain unchecked in the proposed regulations, especially if the pay pool manager and pay pool committee are members of the employee’s immediate organization.
