Reference Subpart F / 9901.607 (a). Suggest that disciplinary history be added as a retention factor under RIF, to be given more weight than service time. For example, in the case of two employees who are equal in tenure group, equal in veterans preference, and have been given equal performance ratings, why should management have to retain the employee who has 14 years experience but who also has had two disciplinary actions taken against him in the last three years, and release the other employee who has only 12 years experience but who has never had any disciplinary problems? The inclusion under NSPS of conduct as a performance factor may lessen the need for this suggested change after several years, but even then it would be wise to have incorporated this retention factor, because there may still be cases where disciplinary action is taken but is not reflected in the performance rating. Recommend the inclusion of disciplinary history as a retention factor between rating of record and creditable service in 9901.607.
