In implementing PL 108-136, Congress did not intend for Secretary Rumsfeld to garner such broad and sweeping power. For example, Secretary Rumsfeld testified before a Congressional committee that he would not waive any part of 5 USC Chapter 71. This proposal is full of waivers, including parts of Chapter 71. It is also full of areas that are given to the Secretary and/or DoD within the sole and exclusive discretion. Where in PL 108-136 does Secretary Rumsfeld interpret gaining the authority to conduct this power grab?
