Comments concerning - Federal Register: February 14, 2005 (Volume 70, Number 29) Proposed Rules: FR Document 05-2582/NSPS (National Security Personnel System) Page 7564: "Under the proposed regulations, the Department may prescribe implementing issuances to establish probationary periods as deemed appropriate for certain categories of employees newly appointed to career service positions covered by NSPS." While management always has the right to issue any implementing order, there still needs to be checks and balances and/or oversight to prevent abuse. "The proposed changes streamline the rules and procedures for taking adverse actions, to better support the mission of the Department while ensuring that employees receive due process and fair treatment guaranteed by the law authorizing the establishment of NSPS." I can not emphasize enough that this is just an unproven assertion. The proposed regulations provide few safeguards. If fair treatment and due process are what SECDEF says they are, then he can assert that the moon is made of swiss cheese as well. Without Congressional or judicial oversight, the potential for abuse is rife.
