Comments concerning - Federal Register: February 14, 2005 (Volume 70, Number 29) Proposed Rules: FR Document 05-2582/NSPS (National Security Personnel System) Page 7576: "Any new NSPS classification, pay, or performance management system covering Senior Executive Service (SES) members ...." Not all DoD SES are covered by NSPS. Why is it that? Other agencies are required to follow NSPS, but not all the DoD SES. "At his or her sole and exclusive discretion, the Secretary may rescind ...." Absolute power .... "the Secretary may, at his or her sole and exclusive discretion, apply ...." This seems to be not very transparent. Does this violate E.O 12988 and 13132?
