Comments concerning - Federal Register: February 14, 2005 (Volume 70, Number 29) Proposed Rules: FR Document 05-2582/NSPS (National Security Personnel System) Page 7586: "Such other action that DoD considers appropriate, as specified in DoD implementing issuances." Is this where the use of the phrase "sole, exclusive, and unreviewable discretion" to be invoked? "A rating of record may be challenged by an employee only through a reconsideration procedure as provided in DoD implementing issuances. This procedure will be the sole and exclusive method for all employees to challenge a rating of record. A payout determination will not be subject to reconsideration procedures." A reconsideration process designed and implemented by the SECDEF with "sole, exclusive, and unreviewable discretion."
