Comments concerning - Federal Register: February 14, 2005 (Volume 70, Number 29) Proposed Rules: FR Document 05-2582/NSPS (National Security Personnel System) Page 7598: "(g) Nothing in this section will delay or prevent the Department from exercising its authority. Any agreements reached with respect to paragraph (e)(2) of this section will not be precedential or binding on subsequent acts, or retroactively applied, except at the Department's sole, exclusive, and unreviewable discretion. (h) Nothing in the process established under this section or in Sec. 9901.917, will delay the exercise of a management right under Sec. 9901.910(a)(1), (2) or (3). (i) Management retains the sole, exclusive, and unreviewable discretion to determine the procedures that it will observe in exercising the authorities set forth in Sec. 9901.910(a)(1) and (2) and to deviate from such procedures, as necessary." This means, in practice, there is no way to stop DoD from doing what is wishes, when it wishes, and how it wishes.
