Poor performance does NOT equate to unlawful conduct and should not be treated as such! The elimination of mandatory performance improvement plans (PIP) WILL be abused by weak managers. The diminshing quality of firstline supervisors deserves consideration in this regard. Under the proposed system, acts of discrimination and persecution will increasingly penalize our older- and disabled workers. Hopefully the AARP and the ACLU will weigh in heavily on this issue!!
