Subpart C – Pay and Pay Administration, section 9901.322. “I object to allowing unfettered DOD discretion on adjustment of rate or band ranges. Congress should require DOD to upwardly adjust all rate or band ranges at least by the percentage pay increase Congress authorizes for all Federal Employees. Allowing DOD to chose not increase rate or band rates commensurate with Congressionally-authorized pay increases unfairly discriminates against older employees who at the top of the band. It penalizes these employees by reducing earnings creditable towards retirement. At the very least, Congress should compel the DOD eliminate this potential age discrimination issue by requiring DOD to adjust all rate or pay bands by the percentage of pay increase Congress authorizes for all Federal Employees.
