Subpart C / 9901.343: Guidance will have to be provided on how and under what circumstances pay reductions for conduct are applied. In a case of reduction in pay for misconduct, can that same misconduct be used in the annual performance rating to lower the rating, which could lower the performance payout? In other words can the same incident of misconduct cause both a pay reduction for misconduct and a pay reduction for poor performance (i.e. principle of double jeopardy)?
