Congress has required DoD to ensure that for the fiscal years 2004-2008, that the aggregate amount of money available for increases shall not be less than the amount that would have been available if there were no conversion to NSPS. We are half-way through FY-2005. Or about 37% of the way from Fy-2004 to FY--2008. NSPS is not yet implemented, and probably won't be implemented for another 3-6 months. It seems to me that Congressional intent is that amount of money addressed is to be for a 4-5 period after implementation. DoD, therefore, needs to make an adjustment to remain consistent with Congressional intent.
