The proposed regulations state that an unacceptable performer is one who does not meet ALL of the performance expectations established by and with the supervisor. There are two problems with this. First, the supervisor has the final say in establishing expectations. That's okay, but he may be unrealistic, or be a very tough supervisor. An employee needs recourse to challenge the expectations, as his supervisor could be establishing expectations that cannot be achieved. Secondly, a really good worker could meet all but one expectation and be considered an unacceptable worker ---- and not receive a pay increase. That is an unfair characterization of that worker, and disturbingly unfair for that worker not receive some sort of raise.
