Comments:
Section 9901.922 of the proposed regulations grants an employee the option of submitting a grievance in their own behalf. It also grants the exclusive representative to be present. It does not allow an employee to select a representative of their own chosing, for that representative to be present. The Union should negotiate that right, and the proposed regulation should put right to privacy by the individual above the right the exclusive representative, and it should afford the right of the employees representative to be present. Allowing the exclusive representative to be present when it is not as the employees representative, may be in violation of Privacy laws, Medical Information protection laws etc.
