In reviewing section 9901.712 Mandatory Removal Offenses, paragraph (a) states "The Secretary has the sole, exclusive, and unreviewable discretion to identify offenses that have a direct and substantial adverse impact on the Department's national security mission." What are these MROs? Who has seen them? To make a statement that "The Secretary has the sole, exclusive, and unreviewable discretion to identify offenses" is in direct conflict with our US Judicial system. The US Justice Department, the federal courts, and the US Office of Special Counsel need to take a careful look at the wording and intent.
