If the objective of the Department is to process appeals to adverse actions in a more timely manner, it makes no sense to insert another step in the process. The MSPB overwhelmingly rules in favor the agencies when adjudicating appeals and with the additional requirements imposed by NSPS, that is not likely to change. The setting up of another review step within DoD not only lengthens the period of time to process an appeal, it is another financial burden on the taxpayers and the national debt. The Department needs to act fiscally responsible, while attempting to make a better system; lengthening the time to process appeals and at a greater cost to the taxpayer, is not acting in a responsible manner. If the Department does not agree with a ruling there are already excellent procedures in place to resolve such a disagreement.
