The Federal Register’s proposed rules give a definition of “supervisor” in Subpart I Section 9901.903 (labor relations). The labor relations definition of a supervisor has always been this broader one, rather than the definition used for other employment purposes. I suggest you include “supervisor” in Subpart A Section 9901.103 and Subpart B Section 9901.204 to clearly delineate it from the definition in 9901.903. It would also be helpful if determinations for the minimum thresholds are very clearly referenced. (Will a person who “supervises” one military person, one formerly Wage Grade person, one formerly General Schedule person and one contractor be considered a “supervisor” in a supervisory pay band or will the traditional SGEG approach be used?) The standard supervisory definitions located elsewhere in 5USC, 5CFR and the Supervisory Grade Evaluation Guide, may be contained in sections and provisions that, for the most part, are no longer applicable. These supervisory threshold determinations affect actions ranging across employment and adverse actions, as well as placement into any newly developed supervisory pay bands.
