Comments on Regulatory Information Number 3206 – AK76/00790 – AH82 A. Supplementary Information 1. Process, Guiding Principles and Key Performance Parameters – Consider adding “loyalty and length of service to the DoD” after “commitment to public Service” in the third bullet. While this new system is specifically intended to emphasize performance, the DoD will realize more benefit from maintaining both a highly productive workforce and a workforce with accumulated experience and knowledge based on many years of service to the DoD. 2. Pay and Pay Administration – Subpart C, Rating Methodology: DoD – Please explain the selection and makeup of the pay pool panel. B. Regulatory Text 3. Subpart A, Section 9901.101(b), second sentence – Consider adding “loyalty and length of service to the DoD” after “commitment to public Service” in the guiding principles to be valued. While this new system is specifically intended to emphasize performance, the DoD will realize more benefit from maintaining both a highly productive workforce and a workforce with accumulated experience and knowledge based on many years of service to the DoD. 4. Subpart D, Section 9901.406(2) – Consider adding “policies” after “internal rules and directives.” Work requirements are often expressed in the policies of an organization. 5. Subpart D, Section 9901.406(5) – Consider revising “any other means” to be more specific, if possible. These words are quite vague. One possible revision might be: “Other knowledge and skills, provided that . . . .” 6. Subpart D, Section 9901.409(g) – It seems inconsistent to allow an employee to challenge a rating of record, but not a payout determination. If an employee receives a higher rating as a result of a challenge, should they not be allowed to then challenge the payout determination, which was based on the lower rating?
