I am concerned about the reduction of internal controls that protect employees from discrimination and malicious action from management. I believe that handicapped employees will be significantly at risk, under the suggested NSPS regulations. Changes in job duties could easily be discriminatory for the handicapped that potential are inable to accomplish them. Additionally, changes in status could also be potentially discriminatory to any employee. Personnel could be assigned different job duties that require training, certification or additional education that may be viewed as an employee failure to maintain adequate skills. Exemption from external review increases the likelihood that malicious management actions could occur without an adequate means of redress.
