An issuance is required for Sec 9901.406(c) because it needs to be made clearer how supervisors will be held accountable. Otherwise, the NSPS reverts to a Good Old Boy system. This could include 360 degree evaluations to be provide to the next higher supervisor. Sec 9901.409(g) should allow an employee to grieve a rating of record as well; this will allow involvement of the employee's union or Weingarten rep. Sec 9901.409 (in general) should include procedures that protect an employee from a capricious manager; and the Challenge process should stridently protect the employee from manager backlash following a challenge. An issuance is required for Sec 9901.805(c) because employees and managers need to know the process ... beforehand. Sec 9901.807(h)(1) is overly conservative if it allows payment of attorney fees only for prohibited personnel practices. This would have a chilling effect on employees who may not be able to otherwise afford to fight the deep pockets of the Government.
