Comments:
Section 9901.312. It appears that the Secretary has unlimited powers. The section states that “the Secretary will establish limitations on maximum rates of basic pay and aggregate pay for covered employees.” This implies that the Secretary can establish a higher maximum rate for some parties than others. Also, the Secretary, at his or her sole discretion, establish an aggregate pay not agreed to by employee representatives or not appropriate for the industry or geographic region. The section should limit the powers of the Secretary and be specific in what the Secretary can/cannot do.
