The Federal Register/ Vol. 70, No. 29, subpart C states that “ In accordance with the NSPS law, to the maximum extent practicable, for fiscal years 2004 through 2008, the aggregate amount allocated for compensation of DOD civilian employees under NSPS will not be less than if they had not been converted to the NSPS.” My first question is what is meant by “maximum extent practicable”; i.e. if there is a budget decrement can civilian compensation be reduced? The next sentence goes on to state that this includes potential step increases and rates of promotion. It does not state anything about the annual cost of living or locality pay increases. Is this included in compensation calculations? Lastly, after FY2009 nothing is mentioned. Does this mean that DOD will no longer be bond to provide what has historically been allocated and can set an amount arbitrarily? The next paragraph goes on to state that formula will be used for the compensation allocation up until FY2008. What happens after FY2008?
