On Feb. 25, 2005 a group of emplyees filed a class action lawsuit against the FAA because they had reached the top of their pay band and were therefore not eligible for a base salary increase under their pay for performance system. It appears that the new NSPS plan will be heading for the same problem unless it is modified to allow people in DoD, who have reached the top of their proposed pay bands, the right to receive annual increases in their base salary rather than just cash bonuses. The proposed NSPS plan could cost really good DoD employees thousands of dollars in retirement pensions by effectively freezing their salaries for years and years - not a very smart plan for incentiving good performance. It seems like DoD is intent on being "Penny-wise and dollar-foolish."
