9901.515 (a)(2) permits management to consider only candidates from the local commuting area. Two concerns: Does this limit the rights of preference eligibles particularly preference eligibles with a disability rating of greater than 10%? Is this appropriate in external hiring competitions? More pragmatically, How will it be done? DoD has established centralized HR Centers in different areas of the country that recruit for positions across the United States. This may appear in the FR as a reasonable idea but with geographically distant regional centers and no known single source document to delineate what the commuting areas may be, these determinations are subject to appeal under USERRA, EEO and other third party reviews. Although an interesting idea, it isn't worth the problems it could potentially create.
