Proposed regulations look good but I do have a question regarding employees not performing agency work during the rating cycle: What provisions are there for performance ratings of employees who perform no agency work during the entire rating cycle (performance year): e.g., reservists called up for military duty and carried on LWOP (could this be a USERRA violation?); employees under the loaned executive programs; employees applying for disability retirement or because of an on the job injury or illness are on the Department of Labor's Office of Workers Compensation Program (OWCP) rolls; and, union representatives who are "full time" union officers and perform no agency work (see 34 FLRA No. 145, Feb 15, 1990) ? Receiving a “presumptive successful” rating now affects not only the potential for base pay increases but also greatly influences retention standing for RIF under NSPS proposes regulations. Thanks SRB
