Federal Register/Vol. 70, No. 20/Monday, February 14, 2005/Proposed Rules, Page 7557, under Eligibility and Coverage, second sentence. After "employees", insert "who volunteer". The new sentence reads - "DoD will transition to the NSPS human resources system beginning with its General Schedule (GS) employees who volunteer (and equivalent). Page 7559, under Pay and Pay Administration -Subpart C, under the sub-heading - National Security Compensation Comparability, first sentence. Delete the words "In accordance with the NSPS law, to the maximum extent practicable", "aggregate” and “allocated for”. Before "compensation of", insert the word “of”, and after “compensation of”, insert the word "individual" so that the new sentence reads: "For fiscal years 2004 through 2008, the amount of compensation of individual DoD civilian employees under NSPS will not be less than if they had not been converted to the NSPS." Page 7559, under Pay and Pay Administration – Subpart C, under the sub-heading National Security Compensation Comparability, second paragraph, second sentence. After “that”, delete “, to the maximum extent practicable, in the aggregate,”, “available” and “, and other changed circumstances that might impact pay levels”. After "that", insert the word "individual". The new sentence will read – “The formula will ensure that individual employees are not disadvantaged in the overall amount of pay as a result of conversion to the NSPS, while providing flexibility to accommodate changes in the function of the organization and changes in the mix of employees performing those functions.” Hold implementation of this system in abeyance until it can be shown that politicization will never creep into the system. DoD exists to serve all of the United States and its territories regardless of political affiliation. Hold implementation of this system in abeyance until the Department of Defense and OPM meet with and satisfy all of the demands of all federal government employee unions. To not do so will invite lawsuits from the stakeholder unions. Include, in specific terms how performance will be measured. The proposed regulations address the periphery of performance management, but never specifically says how performance will be measured.
