Section 9901.914 – Representation rights and duties – The proposed regulations weaken the so-called 'Weingarten' rights for employees subject to an examination by an agency official in connection with an investigation. The employee will still have the right to request a union representative, but, the right will not apply to investigations conducted by the Offices of the Inspectors General and other independent Department or Component organizations whose mission includes the conduct of criminal investigations, such as the Army Criminal Investigation Division and the Air Force Office of Special Investigations. Note: A similar provision was removed during the DHS Meet and Confer. This provision should be removed from this propsal.
