Section 9901.916 – Unfair labor practices – The unfair labor practices set out in the proposed regulations are essentially the same as those currently contained in chapter 71 with one major exception. Under NSPS, it is no longer a ULP to enforce a rule or regulation that is in conflict with an existing collective bargaining agreement. NSPS supersedes the agreements. All agreements that are in place now have been negotiated between labor and management. It is unclear why DoD would want to terminate these agreements.
