Today I learned that the new National Security Personnel System (Premium Pay - Section 9901.361) will give the Secretary of Defense the authority to waive the payment of “law enforcement availability pay” to Special Agents employed by the Department of Defense. I strongly oppose this provision and believe it violates the Law Enforcement Availability Act of 1994 that was passed to ensure that this payment to GS-1811 employees was statutorily required and consistently applied throughout the Federal government. I believe that all GS-1811 (Criminal Investigaotrs/Special Agents) whether employed by the Department of Treasury (ATF, Secret Service), Department of Justices (FBI, DEA), or the Department of Defense should receive equivalent pay since we are all working long hours in the protection of our homeland and Americas war fighters. I have also contacted Senator Charles Schumer and Senator Hillary Clinton to voice my objections to the language set forth in Section 9901.361 which gives the Secretary of Defense the authority to waive availability pay that is statutorily required to be paid to all GS-1811 employees under the Law Enforcement Availibility Act of 1994.
