It is widely announced that the DoD intends to implement the labor relations system immediately throughout DoD; but the labor relations system is part of NSPS, see 5 U.S.C. Section 9902(b)(4); and the law restricts implementation of NSPS in certain parts of DoD. Under Section 9902(c)(1), NSPS may not be implemented at a laboratory before October 1, 2008, and then only if the Secretary makes a determination required by that provision. Under Section 9902(l)(2), NSPS may not be applied to an organizational or functional unit including more than 300,000 employees unless the Secretary determines that the unit has in place a proper performance management system. DoD must comply with these restrictions.
