The proposed NSPS section 9901.905(a) and 9901.914(d)(5) violate Congress’ explicit order in 5 U.S.C. 9902(b) to preserve collective bargaining. In proposed NSPS regulation 9901.914(d)(5), the Department seeks to declare such issuances to be non-negotiable and superior to collectively bargained agreements. This stance is extremely disturbing to me both as an employee and U.S. citizen. This regulation supercedes all rights that we as a nation have held to be in the interest of democracy. It places the employee at the whim of their supervisor even when there is no issue of national security. This is the antithesis of what our nation stands for!
