With respect to 5 CFR Chapter XCIX and Part 9901 Subpart D, the proposed regulations should include a requirement that supervisors and managers performance shall include elements to measure effectiveness in implementing EEO, Sexual Harassment, and ADA polices. Currently supervisors and managers are expected by the work culture to accept the level of discrimination tolerated by the minorities within the work group. This results in the supervisors and managers waiting for the discriminated employee to make a complaint. The expectation is that supervisors and managers will establish the work culture and work place climate so that every DOD employee can perform to their maximum potential. With respect to Subpart D, § 9901.401(b) the performance management system should establish a requirement for supervisors and managers adherence to EEO, Sexual Harassment (Title 10 Section 1561 and 29 CFR 1614), and ADA (29 C.F.R. §1614) principals.
