9901.353 Per this section an employee can be set at a lower rate of pay when moving to a higher pay band. There should be some guarantee that the employee's pay will be higher after promotion, e.g., when an employee is promoted into a higher pay band his/her pay shall be at least 5% greater than it was set in the lower pay band - at least for the initial year, after that it would be subject to the performance-based variables.
