Authority to Establish a New HR system 5 U.S.C Subsection (k) of 9902 DoD and OPM are not limited by any provision of Title 5 or implementing regulations relating to - - The methods of establishing .... - The methods of assigning ... - The methods of reducing overall agency staff and grade levels, expect that performance, ...and such other factors as the Secretary considers necessary and appropriate must be considered in decisions to realign or reorganize the Department's workforce. 1. I take this as meaning that as a Goverment Employee of OSD, my pay can negatively change as found appropriate by the Secretary without any basis. 2. As an OSD Workforce member, if the Secretary sees fit to re-organize DoD, he can do so, placing government employees into positions they may not have skills, training or even the expertise. 3. As an OSD Workforce member, if the Secretary sees fit to reduce the workforce, I may lose my job without basis. 4. I also noticed the regulation protects veterans. That is a good idea. Unfornately, if you are not a veteran, you can be terminated, and pay docked as the Secretary of Defense feels necessary. I do not agree with this regulation. Just under this section alone, my rights are taken away. Since I am exempt from the Labor laws that govern industry, I have no legal recourse. This in short is not right. I believe another rewrite of this regulation is at hand.
