The MSPB chairman reportedly told a congressional subcommittee that the disciplinary process changes soon to take hold at the new Homeland Security Department would put employee's rights at risk and overburden the MSPB judges. He also voiced his concern that due process for employees would be affected. In addition, he raised a concern that DHS rules allow the DHS to bring multiple cases against an employee for the same underlying conduct and that it raises a substantial question of fundamental fairness. He also told the House that his agency would need additional staff to meet the DHS time frames. Since NSPS basically mirrors the DHS personnel plan, it seems to me that those same concerns apply to DoD employees. Won't MSPB have the same problems with the NSPS personnel plan? Shouldn't there have been better collaboration with the MSPB in the development of this new personnel system?
