9901.103: Mandatory Removal Offense: Without further explanation this leads one to question just what is a 'mandatory removal offense?' If it is limited to such things as espionage against the US, intentional destruction of Government property to include data banks, etc. it may be well and good. However, cynicism and experience cause me to think that over time 'mandatory removal offenses' may include bankruptcy, failure of a urinalysis, alcoholism, talking to newsment and insufficient regard for the incumbent Secretary of Defense. This is a catch-all phrase that can stand for anything that the Secretary desires and, with no right of appeal outside of DoD, anyone caught by it is totally excluded from legal protection. Whistle-blowers take note.
