General: I believe the proposed NSPS will sabatoge the Civil Service and hurt the mission of the DOD employees. I am aware of the fact that the current system is broken and needs work, however I do not beleive that the proposed system is the solution. Subpart F Workforce Shaping -9901.401 to 9901-409: In order to make sure that fairness is displayed employees should be able to appeal any performance reating to an independent grievane and arbirtation process like they current system allows now. Subpart C Pay, Sections 9901.301 to 9901.373: The employees in the DOD should continue to receive the same annyal pay across-the board adjustment that other GS.FWS workers receive. Also, the employees should be able to receive annual increases based on the fair and competitive market value equivalent to private sector. Subpart F Workforce Shaping: DoD should not change the current RIF/layoff rules which give balanced credit for performance and the employees years of service to DoD. Subpart G Adverse Actions - 990.701 to 9901.810: Due process and fairness necessitates that the independent body reviewing a major suspension as termination be allowed to alter the proposed penalty if they deem it be unreasonable. The current standards approved by the courts to guide such bodies should continue to be used. Subpat I Labor-Management Relations -I beleive that the labor management law that has governed the employees' right to organize and engage in collective bargaining has worked well for years. There is no legitimate reason to take away most of the collective bargaining rights or grievance rights.
