Reference Subpart C, Pay and Pay Administration, Page 7581, Section 9901.311 Major features. This subsection states: “Through the issuance of implementing issuances, DoD will establish a pay system that governs the setting and adjusting of covered employees’ rates of pay and the setting of covered employees’ rates of premium pay.” This pay system has not been defined, so there is no way to determine if it will be fair and credible to employees. This system should have been defined in these regulations to allow for a meaningful review and comment period, as required by law. No changes should be made to the current pay systems used by DoD agencies until a full comment and review period is completed, followed by a full collective bargaining process with the unions representing DoD employees. A pay system without fair and credible rules, policies, structures, and procedures will be refused by employees, and will result in distrust of management, decreased morale, and lower productivity, ultimately harming national security.
