Comments:
Can you advise how appeals to the FLRA will be handled if the FLRA does not have three members serving. Would appeals be placed in abeyance pending the nomination and confirmation of a third member or would the matter be deemed to have been upheld by the FLRA for purposes of review by appropriate Federal courts? Also, does the DOD believe that the FLRA has the ability to remand matters for further clarification even if such actions were to extend time frames contained in the propsed regulations?
