Penalty Review. “in cases involving a mandatory removal offense, the penalty selected by the department may not be reduced or otherwise modified by MSPB.” If MSPB reviews a case and finds the employer has made a mistake and it is not in accordance with the law, MSPB can do nothing. Why have MSPB review anything, if the out come is the same. This system reminds me of Hitler and his court system,You get a trail and you are always found guilty.
