Agency: Department of Commerce, National Processing Center Docket ID: NSPS-2005-001 RIN #: 3206-AK76 Subpart A -- General Provisions Sec 9901.103 Definitions "Mandatory removal offenses (MRO)" How does giving the Secretary sole, exclusive, and unreviewable discretion promote the efficiency of the government? Guilty or innocent, does not seem to matter, an employee could be removerd from duty just because the Secretary deems it necessary! The employee is basically left with no recourse because the Secretary had unreviewable discretion. The Civil Service Reform Act needs some changes but it has established protections for employees, but this new system seems to virtually wipe those protections away but affording the Secretary sole, exclusive and unreviewable discretion.
