Agency: Department of Commerce, National Processing Center Docket ID: NSPS-2005-001 RIN #: 3206-AK76 Subpart A -- General Provisions Sec 9901.105 Coordination with OPM part (c) Under current classification standards, OPM deems which employees which employees would be considered within the bargaining unit and which employees are deemed not within the bargaining unit. If I am reading this section correctly, the Secretary will establish his own policy for classifying positions. This would allow the Secretary to determine that there are NO positions within the bargaining unit and in affect bust the Union from protecting the employees of DoD.
