Concern about proposed NSPS rules RIN 3206-AK76/0790-AH82, printed in Federal Register 2/14/05. I will comment on Subpart C and D.. Point 1) Subpart C Pay and Pay Adminstration: Performance Payouts - Workers salary will be dependent only upon the subjective and personal judgement of their supervisor. The supervisor has to held accountable. Standards need to be in place to perform checks and balances on this 'power for political advantage' patronage situation. Point 2) Subpart D Performance Management: Setting and communicating performance expectations - If performance expectations are 'flexible' and changed frequently by the supervisor how can the employee ever meet the standards required to earn a performance payout within the life span of that appraisal period? Standards are essential to control this flexibility choice by management and hold them accountable. Point 3)Subpart D Performance Management: Challenging a rating - Negotiated grievances will not be allowed, only internal DOD processes for challenges to performance appraisals. This is a closed door environment with the potential for bias. Management is not held accountable and the possibility of setting the rating straight is non-existent for the employee. I hope you will consider changing the proposed regulation in order to find a fair and balanced working environment within DOD for all employees. Every level of management and staff must be held accountable, not just the staff. Non-DOD abitrators and negotiators need to work alongside employee/management in aspects of relations and policies within DOD to assure fairness. Standards of guidance are essential.
