Agency: Department of Commerce, National Processing Center Docket ID: NSPS-2005-001 RIN #: 3206-Ak76 Subpart B -- Classifications Sec. 9901.352 Setting pay upon Reassignment. Part (b) Any adverse action should afford the employees the opportunity to have a neutral third party (MSPB) to make a proper review of the adverse action taken against the employee prior to the employees pay being cut. Federal employees have been granted the chance through MSPB to have adverse action heard and reviewed by an Administrative Judge. During a hearing the judge could rule in favor of the Agency or the employee. Now this new system wants to strip the employees of the right basically to due process and just give the Secretary sole, exclusive and unreviewable discretion to adversely affect an employees pay, career, and their lively hood whether they are guilty or innocent. What is this world coming to when a criminal in a court of law is treated better than DoD employee?
